Terms of Use

1. Agreement

These Terms of Use ("Terms") are an agreement between you and the developer of Flash it! ("we", "us") and govern your use of the Flash it! iOS application ("the App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

The App is distributed through the Apple App Store. Apple's Licensed Application End User License Agreement also applies. Where these Terms and Apple's agreement conflict, Apple's agreement takes precedence for matters between you and Apple.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Apple devices that you own or control, as permitted by the App Store terms. You may not copy, modify, distribute, sell, lease, reverse engineer or attempt to extract the source code of the App, except where the law expressly allows it.

3. Your content

You keep ownership of everything you add to the App: links, files, text and the cards created from them ("Your Content"). Your Content stays on your device. We do not receive it and claim no rights to it.

You are responsible for Your Content. Only add material you have the right to use. Turning a copyrighted text into flashcards for your own personal study is normally fine; redistributing it is not. Do not use the App to process content that is unlawful, or that contains other people's personal data without a lawful basis.

4. AI-generated cards

The App can generate flashcards using Anthropic's Claude models. Generated cards are produced automatically from Your Content and may be inaccurate, incomplete or misleading. They are a study aid, not a source of truth. Always check important facts against the original material, especially for medical, legal, financial, safety or exam-critical topics.

If you enter your own Anthropic API key, your use of the Claude API is subject to Anthropic's terms, and any usage charges are billed to you by Anthropic. Keep your key private; we cannot recover or reimburse charges arising from its use.

5. Third-party content and links

When you paste a link, the App fetches that page from the third-party website on your behalf. We do not control those sites and are not responsible for their content, availability or terms.

6. Acceptable use

You agree not to:

• use the App for any unlawful purpose or in breach of any applicable law;
• use the App to infringe anyone's intellectual property, privacy or other rights;
• interfere with or disrupt the App, or attempt to bypass any of its security features;
• use automated means to access services the App connects to in a way that violates their terms.

7. Availability and changes

We may update, change or discontinue the App or any feature at any time. We will do our best to give notice of significant changes through the App Store release notes. Features that depend on third-party services (such as AI generation) may stop working if those services change or become unavailable.

8. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be error-free or uninterrupted, or that generated cards will be accurate.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of or related to your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for it, if any, in the twelve months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Termination

You may stop using the App at any time by deleting it. We may terminate or suspend your licence if you breach these Terms. Sections 3, 4, 8, 9 and 12 survive termination.

11. Changes to these Terms

We may revise these Terms from time to time. The current version will always be at flashit.cc/terms with the date it was last updated. Continuing to use the App after a change means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of the country in which the developer is established, without regard to conflict-of-law rules, and any dispute will be brought in the courts of that country, unless mandatory consumer law in your place of residence gives you additional protection.
